Rep. Alan Grayson: I’ll File Suit If Ted Cruz Is The Nominee

Posted by | November 26, 2015 12:11 | Filed under: Politics Radio Interviews

Congressman Alan Grayson told me Wednesday night he’ll sue if Ted Cruz is the Republican nominee. Grayson commented on the GOP field.

GRAYSON: It’s resolved itself into this weird reality show. It’s not “The Biggest Loser” that they’re choosing, it’s “The Biggest Bigot.”

COLMES: That’s very interesting, are they all bigots?

GRAYSON: Show me one who represents the exception here. In a sense I guess Cruz is not technically that way, because technically he’s not even an America.

COLMES: Well, his mother was born here, so I guess like Obama, though it’s interesting to me the people who had a problem with Obama, though it’s interesting to me that the people who had a problem with Obama’s birth certificate don’t have a problem with Ted Cruz who literally was born in another country and renounced his Canadian citizenry.

GRAYSON: I don’t know, the Constitution says natural born Americans, so now we’re counting Canadians as natural born Americans? How does that work? I’m waiting for the moment that he gets the nomination and then I will file that beautiful lawsuit saying that he’s unqualified for the job because he’s in eligible.

COLMES: So you’re saying should he get the nomination, Alan Grayson will file a lawsuit against his candidacy.

GRAYSON: Absolutely! Call me crazy but I think the President of America should be an American.

World class trolling Rep. Grayson. Keep it up….

    • Roctuna November 26th, 2015 at 15:01

Agreed. Why make it easy for ’em? Even a small taste of their unending obstructionism would be worth watching.

      • The Original Just Me November 26th, 2015 at 15:53

Okay, let me think about that for awhile—– Yup, you are correct.

    • granpa.usthai November 26th, 2015 at 17:09

      i like it
      I LIKE IT A LOT!

poetic justice backed by our national legal system.

  2. Guy Lauten November 26th, 2015 at 12:21

Brilliant. The lawsuit would put Cruz’s base in a quandary, now wouldn’t it?

    • The Original Just Me November 26th, 2015 at 15:52

No, this subject was decided years ago. One U.S. citizen parent and you are a natural born no matter where you are born.

      • granpa.usthai November 26th, 2015 at 17:07

        but -but –
it MUST be heard before the courts.

        justice must be served.

        rule of law must prevail.

        it’s the right to appeal.

’till the slow wheels of justice have come full circle.

besides – if Cruz’s mother was a US Citizen, WTF is she doing having the baby of a Cuban communist revolutionary in Canada?

lots and lots of holes that need to be plugged in this one. deep legal holes that must take months and months and years to be filled through the judicial system of our government.

gops should throw this unqualified klown out of the show and look for a new one.

        • granpa.usthai November 26th, 2015 at 17:12

          …AND

there’s also this little thing about being raised by a DEVOUT supporter of Fidel’s Communist Regime.

      • Guy Lauten November 26th, 2015 at 18:52

You’re not getting the import of what I said. Of course those of us who live in a reality-based universe and enjoy lex res understand that both President Obama and Ted Cruz are natural-born citizens of the US. But I am willing to bet that a majority of The Cruz’s base would vehemently argue that Our President is not a citizen, for whatever specious argument they put forward. Their truth is not dependent on any argument, their truth lives in their desire to have things their way. But if they apply the same arguments they have used against Mr. Obama’s citizenship to The Cruz’s, their truth is suddenly at odds with what they desire. Sounds like a “quandary” to me, n’est-ce pas?

        • The Original Just Me November 26th, 2015 at 20:49

Oh, I totally agree with you. Now let me sum it up for you, Republicans are Two-Faced. There, does that work ?

          • Guy Lauten November 27th, 2015 at 14:57

No, not really. Two-faced/duplicitous does not begin to cover the cognitive dissonance these people have to live under.
They are constantly assaulted with information that goes against what they espouse, but instead of considering altering their thinking they do syntactic mental acrobatics and gyrations to attempt to bring two opposite concepts into agreement (e.g “It’s still too early to call Ohio for Obama.”). This is not just duplicitous, this is avoidance of reality, which is generally termed “psychosis”.

    • granpa.usthai November 26th, 2015 at 17:00

‘specially if it goes before the same court!

what was it they were saying about – justice MUST prevail -when many were saying it was STUPID?

  3. Dwendt44 November 26th, 2015 at 12:38

The never ending smears against President Obama are coming home to roost. THIS one actually has some merit.

    • Michael Hallmark November 27th, 2015 at 05:39

      It has none.

      • jybarz November 27th, 2015 at 12:11

        Yes, it definitely has!

  7. whatthe46 November 26th, 2015 at 13:36

yum yum, eating their own is such a wonderful thing to witness.

  8. Larry Schmitt November 26th, 2015 at 13:42

There are enough other reasons for this one to not be president, but his citizenship is not one. The law says if one of his parents was a US citizen, it doesn’t matter where he was born, that makes him a “natural born” citizen. He’s a citizen the same way Romney was, who was born in Panama.

    • Jack E Raynbeau November 26th, 2015 at 13:56

That was McCain. The Mittster was born in Detroit. His father was born in Mexico.

      • Larry Schmitt November 26th, 2015 at 14:16

You’re right. The republicans are all alike, I get them mixed up.

        • The Original Just Me November 26th, 2015 at 15:47

Yea, all Republicans do look a like don’t they. Wait, isn’t that what they used to say in the fifties about another group of people ?

          • Larry Schmitt November 26th, 2015 at 15:48

Yes, but I was referring to their proposed policies and their biases.

            • The Original Just Me November 26th, 2015 at 20:38

Awe, minor details. Just Bash them. That’s where the fun is.

      • granpa.usthai November 26th, 2015 at 16:54

I thought Romney (a Latino of Gringo descent?) was born in Windsor? I know he has a FAKE birth certificate from Michigan -which is really a vital statistics record and not a birth certificate at all.

        • Larry Schmitt November 27th, 2015 at 14:50

Are you sure you’re not a republican? You would fit right in.

I like Alan but he’s barking up the wrong tree this time…
    .

    • The Original Just Me November 26th, 2015 at 15:45

I don’t think it is barking up the tree that he is doing. But he is definitely doing something on the tree.

        :)

Like the dog peeing on the poster of his face? I didn’t know how to post it here, maybe you’ve seen it?

        • The Original Just Me November 27th, 2015 at 14:05

Yup, seen it and it is appropriate.

    • granpa.usthai November 26th, 2015 at 16:44

      how?

-cruz refuses to show his REAL birth certificate.

-even if he does have a real one from Canada (that would certainly have something in the seal) it will only prove he is a Canadian born ‘anchor baby’.

-aside from his father being very closely related to the Cuban Communist Party, Rafael Edward won’t even use his real name – that would disqualify any legal documents.

let’s face it: Rafael Edward Cruz is disqualified from the get go.

      gop’s should choose another candidate.

      • frettadafrog November 27th, 2015 at 11:33

I keep reading on different blogs about a Form N 600. That’s an application for certificate of citizenship in Canada. Does he have one, I wonder?
I’ve also read that only he, Ted Cruz can get his FOIA files.

  10. Rocky in Texas said... November 26th, 2015 at 15:40

and I think cruz’s daddy needs to be investigated because I think he was planted here by Fidel Castro to help destroy us from within. All the cruz family does is spew hate and stupid across our great Country.

  11. cogitoergodavesum November 26th, 2015 at 18:00

Presumably Cruz won’t get picked for the VP spot, if Trump, or some other birther, gets the nomination.
“Heavens forbid, Mr Trump, that you should die in office, but can America afford the risk of an unconstitutional successor?”

  12. Suzanne McFly November 26th, 2015 at 18:02

Sounds good to me, beat them with their own bat.

    • Michael Hallmark November 27th, 2015 at 05:37

Their “bat” is stupidity. Why would Democrats stoop to the same idiotic logic that Conservative extremists used on the President? It didn’t work for them, and it won’t work against Cruz. His mother was a US Citizen. Cruz is a US Citizen.

      • Suzanne McFly November 27th, 2015 at 09:41

I wouldn’t support a constant use of this type of strategy, but every once in awhile can work.

      • jybarz November 27th, 2015 at 12:05

You obviously don’t know what qualifies as natural born American citizen.

        • The Original Just Me November 27th, 2015 at 14:09

By your comment, you do not understand the law on this either. it was settled in the courts many years a go. Cruz is a Natural Born Citizen because he has at least one parent who is a U.S. citizen. Like it or not, it is the law.

        • bpollen November 27th, 2015 at 16:31

What he stated is correct. Unless you can show where he (Cruz) was “naturalized,” he’s a natural born American.

You might wanna brush up on the facts before chastising others on the validity of their statements.

          From the Harvard Law Review:

“The Constitution directly addresses the minimum qualifications necessary to serve as President. In addition to requiring thirty-five years of age and fourteen years of residency, the Constitution limits the presidency to “a natural born Citizen.” All the sources routinely used to interpret the Constitution confirm that the phrase “natural born Citizen” has a specific meaning: namely, someone who was a U.S. citizen at birth with no need to go through a naturalization proceeding at some later time. And Congress has made equally clear from the time of the framing of the Constitution to the current day that, subject to certain residency requirements on the parents, someone born to a U.S. citizen parent generally becomes a U.S. citizen without regard to whether the birth takes place in Canada, the Canal Zone, or the continental United States.”

  13. allison1050 November 26th, 2015 at 18:49

    Gawd! I luv Grayson. ;)

  14. The Original Just Me November 26th, 2015 at 20:44

Here’s a little thought to play with. Cruz’s mother is a U.S. citizen so he is also a U.S. citizen. Cruz was born in Canada so he also is a Canadian. His father is a Cuban citizen so he could possibly claim Cuban citizenship. Hell, he could be the President of all three North American Countries. Now if he would only marry a Mexican.

    • Larry Schmitt November 27th, 2015 at 13:57

Except that Canada has a Prime Minister. Let’s just take the easy way and make him Emperor of North America. Except for Greenland. That belongs to Denmark.

      • The Original Just Me November 27th, 2015 at 14:02

That Big Thundering roar that you would hear is the MASS EXIT of people leaving if this Brainless ever got close to the White House.

        • Larry Schmitt November 27th, 2015 at 14:53

No, because this country is bigger than any one man, even a gigantic ignoramus as this one. We survived Nixon, and Bush, we could survive this guy. (I can’t force my fingers to type “President” before his name) Besides, think how much fun it would be removing him from office.

          • DownriverDem November 27th, 2015 at 22:43

We know that it’s not just the president you have to survive. .It’s the House, Senate; and Supreme Court

        • DownriverDem November 27th, 2015 at 22:36

It’s the total control of the House, Senate and Supreme Court that would come along with Cruz that would be the ultimate disaster.

          • The Original Just Me November 27th, 2015 at 22:44

isn’t that scenario covered in the last book of the Bible, Revelations ?

Sorry, Alan, but I don’t think you have a leg to stand on.

I have a sister that was born in Japan. She’s NOT Japanese. She’s American enough that selective service sent her a draft notice. Boy, were THEY embarrassed when she showed up for the physical.

  18. jybarz November 27th, 2015 at 17:35

Case closed? Cruz thinks so, as he told Fox News host Sean Hannity on March 23:
Cruz, March 23: The facts are clear. I was born in Calgary. My parents — as a legal matter, my mother is an American citizen by birth. And it’s been federal law for over two centuries that the child of an American citizen born abroad is a citizen by birth, a natural born citizen.

Indeed, the Naturalization Act of 1790, passed three years after the U.S. Constitution was written, said that “the children of citizens of the United States, that may be born beyond sea, or out of the limits of the United States, shall be considered as natural born citizens.”
But as the CRS pointed out in its report, the 1790 law was superseded by the Naturalization Act of 1795, which changed the language from “natural born citizens” to just “citizens.”
So there is still some lingering uncertainty about Cruz’s eligibility. That’s because the Supreme Court hasn’t ruled on the meaning of “natural born citizen,” which the Constitution doesn’t define.
This is not the first time that a Republican presidential candidate faced such questions. As we have written before, John McCain, who was the Republican nominee in 2008, was born to U.S. citizens in the Panama Canal Zone, and Barry Goldwater, who was the party’s nominee in 1964, was born to U.S. citizens in Arizona before it was a state. George Romney, who was born to U.S. citizens in Mexico, ran for president in 1968, but did not win the nomination.
Even Duggin, who wrote in her 2013 article that “a scholarly consensus is emerging … that anyone who acquires citizenship at birth is natural born for purposes of Article II,” acknowledges that the issue may not be settled.
“In the absence of a definitive Supreme Court ruling — or a constitutional amendment — the parameters of the clause remain uncertain,” she wrote.
    — D’Angelo Gore

      Take note :

      — D’Angelo Gore

In Obama’s case, he was born in Hawaii, a part of the USA.

Repukes made and is still making a lot of song and dance about him not being born in Hawaii, but in Kenya or Indonesia or other Bullsh!t country.

Why? Because being born in the USA and with an American parent is 1,000,000% sure he’s a NATURAL BORN AMERICAN!

      • Lucie Ke November 28th, 2015 at 12:39

buy you need to understand where these ppl come from, When you hear hawaii authority says ‘no he wasn’t really born here” that puts doubt in ppl mind. So if Cruz parents are citizens then he is a citizen as well. Grayson is looking for trouble cause he dont want someone to run cause he don’t like him. If it didn’t matter to him he would shut up. I think if he is so concerned about cruz then maybe he should file now.

        • tracey marie November 28th, 2015 at 13:29

Maybe you birthers should shut the hell up. Obama was born in Hawaii, but if he wasn’t he is still a citizen his mother is American. Rafael is a baggerbirther dominist born in Canada from a commie father who fought with and for fidel.

          • Lucie Ke November 28th, 2015 at 16:42

Maybe YOU should shut up. It was an official who claimed that document was a fake. I am not saying Obama is not or is a citizen, kinda late for all that don’t you think. So lets leave it at that.

            • tracey marie November 28th, 2015 at 16:52

Nope, the official said just the opposite. You birthers are stuck on lies and innunedo and I will not leave it at that.

        • tracey marie November 28th, 2015 at 13:33

The official said he WAS born in hawaii, period.

        • Dave B. November 28th, 2015 at 18:03

So what else does the voice of your “hawaii authority” tell you? Do you actually…SEE this “hawaii authority,” too? Does it arrive on a unicorn, perhaps?
