Judge David Bunning has ordered Kim Davis released from jail.

He ordered her not to interfere with clerks in her office issuing marriage licenses to all legally eligible couples…

Last week, U.S. District Court Judge David Bunning ordered Davis to jail after finding her in contempt of court for refusing to issue marriage licenses to gay couples in Rowan County following June’s U.S. Supreme Court ruling legalizing same-sex marriage…

“If (Davis’ deputies) can issue licenses under someone else’s authority … Kim Davis would not stand in the way of that,” one of her attorneys, Roger Gannam, told CNN’s “New Day” on Tuesday.

Davis’ legal team on Monday asked the appeals court for an injunction that would prompt Kentucky Gov. Steve Beshear to remove her name from the licenses — something Davis’ lawyers say Beshear has the power and obligation to do through an executive order.

Davis’ lawyers say removing her name would be a reasonable accommodation, and that such an accommodation is required under Kentucky’s Religious Freedom Restoration Act.

        Except, now, her deputies have been authorized by the court, to sign off on marriage licenses. So, she’ll be able to go back to work and still not issue same sex marriage licenses, herself. As long as she doesn’t interfere with her deputies’ handing out of licenses, she’s free to not hand them out, herself.

          That’s the big IF here. She seems to enjoy being the big cheese and ordering her subjects around. They were in fear of her before, she may demand that they go back to being obstructionists again. Should she fire one in the near future for issuing a SS license, then the sh!t will hit the fan.

            She should fire all of the clerks that issued licenses while she was in jail for insubordination. Then that will leave only her son in place when she is sent back to jail. Her son will soon join her in jail and there will be no clerks available to issue licenses at all. Since she is not removed from the office, I would assume she has the hiring authority for the assistant clerk positions. So I don’t see any new clerks being added while she is in jail.

            Now if her employer (i.e. the State of KY or maybe her county?) was not happy with her performance then they should impeach her. Or the voters can vote her out at the next election. If neither of those happen, then it would seem that she has the approval of her employer for her job performance.

              Yes the state legislature should impeach her. But they don’t meet until January. She may well not win re-election. You can bet that making the county a laughing stock nationally won’t be a good thing then and any opponent will not let her or the voters forget. There’s no real limit to how long she could sit in jail on contempt charges. IF she continues her tyrannical ways, she may well stay there until a new Chief Clerk is elected in 2018.

    I had a bad feeling about putting her in jail, she should have been fined and ordered to stay away from the office. At some point she will be released, and when she does they will claim victory and celebrate, now watch for more to defy the ruling around the country.

    Hopefully her release is contingent on a house arrest and no public speaking.

      It’s not a victory though. The licences were issued and the marriages can now happen. If they claim victory, it will just be self-delusion. What will have to happen is State laws are going to need to be updated to be in compliance with Federal law. If that means that deputy clerks can issue licenses, then that will need to be written into law at the state level. I think in the end, it is just going to make it harder for county clerks to win elections if they won’t do their job.

      She got the victory she wanted. She didn’t have to sign off on same sex marriage licenses. If the governor orders a religious accommodation, she’ll be able to assign someone else in the office to issue same sex marriage licenses and she’ll never be required to do so, in the future.

    I would still rather have seen her step down. If you can’t perform the functions of your job, you shouldn’t get to keep it. As a security officer, I can’t refuse to perform a duty on “religious grounds”, or I’ll be fired. It shouldn’t be any different for her. the Governor may have the authority to create a workaround for her religious objections, but I think it will be a mistake to do so. When you’re elected to do a job, you should be willing to fulfill ALL lawfully required duties and obligations. Otherwise, resign and make way for someone less willing to let their “beliefs” deny others their rights.

    I love the signs especially the 1 the dumb kid is holding. I would love to see him disobey traffic laws, not pay his property tax or as the case may be not pay rent, not have a driver’s license or auto insurance. Go grocery shopping and tell the cashier that he’s not going to pay for his groceries. Not pay his electric bill or water and garbage bills, the list could go on forever. Just 1 last thing, when he needs to dial 911 and nothing happens what then? ;o)

      Married four times. The only reason she ran as a Democrat is because the county is over 60% Democratic. Even then she didn’t win the general election by a huge margin. The two opponents in the primary were as qualified as she was, as was the Republican opponent in the general. The country itself is also a poor county compared to some in KY.

    I used to have firm faith in the wisdom, knowledge, and education of members of the Judicial branch. Since the pervert marriage rights ruling, no more! although I was starting to have doubts after the eminent domain ruling.

    Sounds like the Judge was introduced to some Bible passages written by the One True Judge.

    In the future, Magistrates should only be allowed on the bench if they have read God’s Laws and Judicial Tradition from Babylonian times.

    We can’t have Harvard-educated cleaning ladies making far-reaching social decisions. It will turn America into the third world.

          Agreed but because she is a county clerk and is voted into that position the only way is to wait for the general assembly and hope they impeach her, call a special session and hope they impeach her, wait for the general assembly and start to set a law that would make sure she or anyone else couldn’t pull something like this or else be immediately impeached, or she resigns. So it’s a quick fix to a real problem but it’s a fix.

      Since this is a secular country under a secular Constitution, and since the law of the land says explicitly that this country is in no way based on the christian religion, the judge was doing the right thing as was the Supreme Court that applied the ‘equal protection’ clause of the 14th Amendment.           You better read that bible again. Bible supports polygamy, slavery, incest, child abuse, rape marriage, killing those that disagree with you and a long list of things we, as civilized people no longer permit.
          Lot had repeated sex with his daughters, Noah’s grand children all married their first cousins. Eve’s sons had sex with her to create the next generation. Onan was commanded to have sex with his brother’s wife but refused and was killed for not doing so. The list goes on.

        States work with religious organizations for some services currently without violating the 1st Amendment. For instance, here in Memphis, the state funding for public healthcare was moved from Planned Parenthood to a religious based organization that offered more locations for services. Now obviously this group does not offer abortion services, but nobody has claimed it violates the 1st Amendment for them to get state funding.
