Officer Darren Wilson Not Showing Up In Court

Posted by | October 28, 2014 10:52 | Filed under: News Behaving Badly Politics Top Stories

A number of cases are being dismissed because Ferguson, MO cop Darren Wilson is a no-show.

Wilson is looking to avoid the media and the public—he has not been seen since August 9—but his absence is starting to impact the job he left behind. It’s now being reported that a total of six criminal cases have been dismissed, because Wilson, as the arresting officer, isn’t showing up to court to testify.

Ed Magee, spokesperson for the St. Louis County Prosecuting Attorney, told NBC News the cases were all dismissed because Wilson “wasn’t available.” Wilson will not be penalized for this act, say Magee, adding “We don’t get people in trouble for not showing up for court.”

Magee told the St. Louis Post-Dispatch that a case dismissed on Monday was  the “sixth low-level drug case connected to Wilson to be dropped in recent weeks,” though details of the first five closed cases are unknown. This most recent case, brought against Christopher Brooks who was arrested in 2013, is a felony drug charge.

Wilson was a no-show for September’s preliminary hearing in the case, then avoided a grand jury appearance as well. As the primary witness, the case could not proceed without him and the judge ruled to dismiss it. This particular arrest, notes the Post-Dispatch, “had led to a commendation for Wilson in front of the City Council earlier this year.” Brooks, however, claimed Wilson had beat him during the arrest, while he was handcuffed and helpless.

    Darren Wilson is a coward.

It’s comical that Wilson had the privilege of waiting until he and his handlers saw what all of the forensic evidence showed before he gave a statement. The fact that Browns blood is in the car, on the gun and on Wilson matches perfectly with what his friend said and what other witnesses said. If ANYONE had a gun in one hand, and was pulling you near by your collar while threatening to shoot you, wouldn’t you also try to push the gun away to prevent getting your face shot off?! Of course any of us would do that, only an idiot would stand and allow themselves to get shot. However, all of the nut cases out there following the crooked cop, are trying to slant and spin the blood evidences to meet their agenda. IT;s also fascinating that 7 or more eyewitnesses who saw that Wilson shot a surrendering boy, are not reliable, but 1 officer’s word is taken as if he is GOD.Even if he walks, he will never find peace. He will be running and looking over his shoulder forever more.

        But not you.

Of course Wilson isn’t going to show-up. If he does and testifies to things and they turn out to not be true he perjures himself and that makes everything else he has done look suspicious. If you are going to plead the fifth and take your chances with a jury, you need to keep your mouth shut at all costs.

    • R.J. Carter October 28th, 2014 at 12:21

If he does show up, there would be so many protesters storming the court that they wouldn’t be able to try the cases anyway.

Magee, added “We don’t get people in trouble for not showing up for court.”

Really? Huh, as I remember it, if a regular person is ordered to appear and fails to do so he gets a bench warrant slapped on his ass, which can and regularly does cause all sorts of trouble for that person. I’d like to know where in the statutes it says police officers can flaunt the Order to Appear with impunity. Or is this just another way the cops put themselves above the law?

    • mea_mark October 28th, 2014 at 11:20

If no subpoena was issued he doesn’t have to show. The question is, why wasn’t one issued? Is the cover-up of Wilson’s actions extending to the judges and prosecutors? I hope the DOJ Holder is looking into this and investigating the whys.

    • m2old4bs October 28th, 2014 at 11:48

      My thoughts exactly.

  9. Pistol-Packing October 28th, 2014 at 11:23

I dont blame him for one moment for not appearing in a public place. in the aftermath of what happened, I am sure he is being advised to stay away. Dont put yourself in a position for more harm to be done.

    • Larry Schmitt October 28th, 2014 at 11:25

Then he needs to get a different job. Part of the job description of a police officer is to testify in court. And he put himself in this position in the first place by shooting an unarmed man.

      • Pistol-Packing October 28th, 2014 at 11:38

Dont kid yourself, he will never work in law enforcement again. That carer is long over. And as far as shooting an unarmed man, at what point would he have actually known that he was not armed with a weapon of some sorts?? People seem to forget that little detail that “NOBODY” would have known until afterwards.

        • Foundryman October 28th, 2014 at 11:43

Probably at the time when the kid was grabbing for his gun in the car instead of pulling his own gun out and firing…Running away afterward would be a pretty good indication he wasn’t armed also…

          • Pistol-Packing October 28th, 2014 at 11:53

            Nope, it wouldn’t….

        • Larry Schmitt October 28th, 2014 at 12:01

So the cops are trained to shoot people just in case they have a gun? That’s reassuring.

          • Pistol-Packing October 28th, 2014 at 12:04

Cops are trained to shoot to eliminate the Threat….

So on the basis there was an altercation inside the vehicle. And there was violence. It is safe to say, that there is still an active threat.

            • Larry Schmitt October 28th, 2014 at 13:03

Yes, because all those scary black people are threatening the white cops.

              • Pistol-Packing October 28th, 2014 at 13:26

I guess you forget that black cops shoot black people also ???

Not in Ferguson, there are only 3 black cops on a force of about 100.

                  • Pistol-Packing October 28th, 2014 at 14:27

                    And why is that???

                    • Larry Schmitt October 28th, 2014 at 15:33

Why are there only 3 black cops in Ferguson? Why ask me? I’m not the Ferguson PD HR officer.

                    • Pistol-Packing October 28th, 2014 at 16:42

well, it was all over the news when the media was trying to make a big stink about the same thing you are. thought maybe you heard. So let me clue you in.

Black Men/women don’t Apply for the job…They all but said they beg for persons of color to come join the force.

your right, it did not happen overnight. But the issue at hand is there is a select element that wants to make it as it did…

                    • greenfloyd October 29th, 2014 at 11:38

The homies know how the system works and don’t want to be a part of the New Jim Crow.

HAHAHAHAHAHA….. The “New Jim Crow” ???? Now that is FUNNY !!!!!

                    • greenfloyd October 30th, 2014 at 22:33

“What’s so funny!?” he asked with incredulity.

                    • Pistol-Packing AKA "Susie" October 30th, 2014 at 22:55

That you think there is any correlation between black people not joining the police force and New Jim Crow Laws….

                      Very humorous actually

                    • greenfloyd October 30th, 2014 at 23:57

While I fail to see the humor, what do you suppose accounts for the dearth of black people applying?

                    • Laura Flannery October 28th, 2014 at 19:16

They should only hire black policemen in Ferguson going forward. I’m sure there are plenty of young black men in the community who can police their own neighborhoods. This way if anything happens, God forbid, we can take the race card off the table

                    • Larry Schmitt October 28th, 2014 at 19:29

Again, that’s not what I said. You’re projecting. This problem in Ferguson didn’t happen last week. It’s been going on for years. There will be resentment when a majority black community has a police department that’s almost completely white. This didn’t happen overnight, and it won’t be solved overnight.

                    • Laura Flannery October 29th, 2014 at 14:45

I did not say you wrote that. That is MY opinion. I think it would best serve the black community if the majority of police were black. They tried that here in NY after Abner Louima, but the black officers were going to sue the NYPD. I don’t remember why, I think they thought it was reverse racism. I don’t see why the cops would be against this. It could only be a win/win for all in the community. They may have to lower the test standards, but we do that in many fields now. If that will placate the black community and help quell the never ending charges of racism, that’s what we should do. At least try it for a few years in Ferguson.

              • Laura Flannery October 28th, 2014 at 19:21

Here is the story of hispanic cops beating a white homeless man to death on FILM, and they get away with it and walk free.

Show me where I said black or Hispanic cops don’t beat up other ethnic groups. I’m talking about Ferguson, as it is now.

” It’s now being reported that a total of six criminal cases have been dismissed, because Wilson, as the arresting officer, isn’t showing up to court to testify.”

” Dont put yourself in a position for more harm to be done.”
Putting yourself in harms way is precisely the job description of a police officer.
He’s thrown in the towel by letting his caseload back on the street.

      • fancypants October 28th, 2014 at 11:35

after thinking over my post (below) im almost sure this is whats going to happen after election day or possibly after the 5th of nov.
My best guess is Darrin is no where near st.louis or possibly in federal witness protection.

        • Pistol-Packing October 28th, 2014 at 11:39

          very probable….

          • fancypants October 28th, 2014 at 11:42

            • Pistol-Packing October 28th, 2014 at 11:45

It wouldn’t surprise me. But here is a question. When is the term for this Grand Jury over? That should tell you something also.

              • fancypants October 28th, 2014 at 11:46

there is no time limit So they can stretch this out as long as they need to before they make it public

                • Pistol-Packing October 28th, 2014 at 11:49

I dont think that is the case. I just read the term ends in Mid November. I “Believe” (not Sure) that before they are dismissed they have to wrap up all cases that were presented to them.

                  • R.J. Carter October 28th, 2014 at 12:18

The local news here has consistently stated that the GJ decision is expected in mid-November.

            • Laura Flannery October 28th, 2014 at 19:14

Isn;t the Justice Dept looking into this case as well? They can bring civil rights charges against him and then make it a federal case. Holder can do this right before the election.

              • fancypants October 29th, 2014 at 16:32

that might be possible However eric holder already turned in his resignation papers over a week ago

        • William October 28th, 2014 at 11:54

He’s not eligible to be in the federal witness protection program.

          • fancypants October 28th, 2014 at 11:59

he’s not supposed to cut felons loose or blow off court either. witch one of us is right ?
I will even bet Darrin hasn’t been on patrol or seen in public recent days.

            • M D Reese October 28th, 2014 at 13:27

              Not since August 9.

              • fancypants October 29th, 2014 at 16:38

No surprise I understand Darrin might be getting threats but im sure the victims family gets threats too. This in no way is justice no matter how you look at it.

                • M D Reese October 29th, 2014 at 19:10

Mis-handled from the minute Darren stopped his car.

      • Pistol-Packing October 28th, 2014 at 11:36

yes, and I am sure he is being directed to by his superiors. With all of the rioting and looting and destruction of property. I am quite positive it is more of an order.

        • William October 28th, 2014 at 11:53

Why doesn’t the DA ask for a continuance? Throwing 6 criminal cases in the dumper? I’m not buying that.

          • Pistol-Packing October 28th, 2014 at 14:02

Dont know if he is allowed to?? I am assuming it is the day of the trial that this is being found out. And may be no time or for that matter justification… But I am guessing at that.

            • William October 28th, 2014 at 14:17

Dont know if he is allowed to??
Of he’s allowed to. Motioning for a continuance because the officer isn’t available is pretty common.

              • Pistol-Packing October 28th, 2014 at 14:27

I will take your word for it. As I said, I am guessing.

          • Laura Flannery October 28th, 2014 at 19:12

Who would believe the testimony of the killer of a gentle giant? Wouldn’t the defendants lawyer bring up this fact and try to have the cases dismissed? If they are black couldn’t their lawyers say he arrested them out of sheer racism? If he shot a sweet, gentle boy with his hands up and down on his knees, what might he do to a nice young man smoking pot? Perhaps he even planted the drugs or gave someone a ticket just because of his hatred for blacks. Plus if the defendants are black it is a win, win for the community, one less black man in jail.

            • William October 28th, 2014 at 19:21

I’m going to assume your comment is snark, as even the most casual observer understands that bringing up a completely unrelated case would be objected to and earn the offending attorney a sidebar, a meeting in chambers or worse.

              • Laura Flannery October 29th, 2014 at 14:51

It was a snark, but you are forgetting what they did to Mark Furman when he testified in the OJ case. He used the “N” word 20 years before and he was deemed a racist who planted all the eveidence against OJ. Remember? So, why wouldn’t a good attorney use the race card in any case that Wilson is involved in?

                • William October 30th, 2014 at 09:08

Well, as a former police officer I’m pretty sure that a police department in a community that is 67 percent black yet only has three black officers has a serious problem. That’s not a race card. That’s a statistic.
Further, entering into evidence a glove that doesn’t fit the suspect isn’t racist, it’s stupid.

                  • Laura Flannery October 30th, 2014 at 13:52

Thank you for your service. The glove had nothing to do with the race card, which was used to bludgeon Furman. You are correct about the lack of black police officers in that dept. Why do you think that is and what can be done about it? I firmly believe that black police officers should police black neighborhoods. Obviously they do not trust their current police dept. How was the situation before the death of Mr. Brown? Was it tense? Was there a history of police brutality? How were community relations with the police?

          • greenfloyd October 29th, 2014 at 11:47

With the uptick in voter reg and activism the DA probably figures he’d never get a jury to convict on non-violent drug “crimes,” especially for pot. Hope that’s true and it spreads far and wide!

      • R.J. Carter October 28th, 2014 at 12:16

Had he shown up to these cases, would they have been tried or drowned out by all the attendees who would show up for Mike Brown?

        • William October 28th, 2014 at 14:15

Had he shown up to these cases, would they have been tried or drowned out by all the attendees
Uh no. A judge can and will sequester anyone not directly involved in the case at hand. A judge can also hold in contempt and direct anyone who disrupts a case to the county lock up. It’s pretty sad that we have allowed our justice system to be bullied.

          • R.J. Carter October 28th, 2014 at 14:21

            I completely agree!

          • greenfloyd October 29th, 2014 at 11:44

The system has not been bullied! Just the opposite, especially for Black people in Ferguson, or any other poor, minority community. Although I understand that’s not what is at issue here.

Then he needs to get a different job. Part of the job description of a police officer is to testify in court. And he put himself in this position in the first place by shooting an unarmed man.

      • Pistol-Packing AKA "Susie" October 28th, 2014 at 11:38

Dont kid yourself, he will never work in law enforcement again. That carer is long over. And as far as shooting an unarmed man, at what point would he have actually known that he was not armed with a weapon of some sorts?? People seem to forget that little detail that “NOBODY” would have known until afterwards.

        • Foundryman October 28th, 2014 at 11:43

Probably at the time when the kid was grabbing for his gun in the car instead of pulling his own gun out and firing…Running away afterward would be a pretty good indication he wasn’t armed also…

          • Pistol-Packing AKA "Susie" October 28th, 2014 at 11:53

            Nope, it wouldn’t….

        • Larry Schmitt October 28th, 2014 at 12:01

So the cops are trained to shoot people just in case they have a gun? That’s reassuring.

          • Pistol-Packing AKA "Susie" October 28th, 2014 at 12:04

Cops are trained to shoot to eliminate the Threat….

So on the basis there was an altercation inside the vehicle. And there was violence. It is safe to say, that there is still an active threat.

            • Larry Schmitt October 28th, 2014 at 13:03

Yes, because all those scary black people are threatening the white cops.

              • Pistol-Packing AKA "Susie" October 28th, 2014 at 13:26

I guess you forget that black cops shoot black people also ???

                • Larry Schmitt October 28th, 2014 at 14:23

Not in Ferguson, there are only 3 black cops on a force of about 100.

                  • Pistol-Packing AKA "Susie" October 28th, 2014 at 14:27

                    And why is that???

                    • Larry Schmitt October 28th, 2014 at 15:33

Why are there only 3 black cops in Ferguson? Why ask me? I’m not the Ferguson PD HR officer.

                    • Pistol-Packing AKA "Susie" October 28th, 2014 at 16:42

well, it was all over the news when the media was trying to make a big stink about the same thing you are. thought maybe you heard. So let me clue you in.

Black Men/women don’t Apply for the job…They all but said they beg for persons of color to come join the force.

                    • Larry Schmitt October 28th, 2014 at 19:30

                      Read my comment above.

your right, it did not happen overnight. But the issue at hand is there is a select element that wants to make it as it did…

                    • floyd[@]greenfloyd.org October 29th, 2014 at 11:38

The homies know how the system works and don’t want to be a part of the New Jim Crow.

                    • Pistol-Packing AKA "Susie" October 29th, 2014 at 20:19

HAHAHAHAHAHA….. The “New Jim Crow” ???? Now that is FUNNY !!!!!

                    • floyd[@]greenfloyd.org October 30th, 2014 at 22:33

“What’s so funny!?” he asked with incredulity.

                    • Pistol-Packing AKA "Susie" October 30th, 2014 at 22:55

That you think there is any correlation between black people not joining the police force and New Jim Crow Laws….

                      Very humorous actually

                    • floyd[@]greenfloyd.org October 30th, 2014 at 23:57

Here is the story of hispanic cops beating a white homeless man to death on FILM, and they get away with it and walk free.

                http://www.salon.com/2014/01/14/cops_who_beat_homeless_man_to_death_walk_free/

                • Larry Schmitt October 28th, 2014 at 19:27

Show me where I said black or Hispanic cops don’t beat up other ethnic groups. I’m talking about Ferguson, as it is now.

    • William October 28th, 2014 at 11:29

        • Pistol-Packing AKA "Susie" October 28th, 2014 at 11:39

          very probable….

          • fancypants October 28th, 2014 at 11:42

yup I think they are going to wait until after all the elections before dropping the bad news

            • Pistol-Packing AKA "Susie" October 28th, 2014 at 11:45

It wouldn’t surprise me. But here is a question. When is the term for this Grand Jury over? That should tell you something also.

              • fancypants October 28th, 2014 at 11:46

there is no time limit So they can stretch this out as long as they need to before they make it public

                • Pistol-Packing AKA "Susie" October 28th, 2014 at 11:49

      • Pistol-Packing AKA "Susie" October 28th, 2014 at 11:36

yes, and I am sure he is being directed to by his superiors. With all of the rioting and looting and destruction of property. I am quite positive it is more of an order.

        • William October 28th, 2014 at 11:53

Why doesn’t the DA ask for a continuance? Throwing 6 criminal cases in the dumper? I’m not buying that.

          • Pistol-Packing AKA "Susie" October 28th, 2014 at 14:02

Dont know if he is allowed to?? I am assuming it is the day of the trial that this is being found out. And may be no time or for that matter justification… But I am guessing at that.

            • William October 28th, 2014 at 14:17

Dont know if he is allowed to??
Oh he’s allowed to. Motioning for a continuance because the officer isn’t available is pretty common.

              • Pistol-Packing AKA "Susie" October 28th, 2014 at 14:27

          • floyd[@]greenfloyd.org October 29th, 2014 at 11:47

          • floyd[@]greenfloyd.org October 29th, 2014 at 11:44

The system has not been bullied! Just the opposite, especially for Black people in Ferguson, or any other poor, minority community. Although I understand that’s not what is at issue here.

The fact is Wilson was never going to charged from day one. He will walk folks because cops are given the benefit of the doubt in these kinds of cases. Whether or not he felt threatened DW said he did and that’s all that is basically needed. We all have to live with it and move on because it’s not going to change (at least not in this case)…

    • Kick Frenzy October 28th, 2014 at 16:48

It’s not an “attitude” that I have..it’s a fact that cops have the upper hand in these kinds of cases. I hope that Wilson is indicted but then again there will also be a blizzard in Miami this winter…

        • Kick Frenzy October 29th, 2014 at 14:42

I’m not saying it isn’t a fact of lief in many cases.
But, saying “We all have to live with it and move on because it’s not going to change” is a bit of a defeatist attitude… whether you feel that way or not, it sounds that way.

instead of just living with it, it makes more sense to continue making noise about these things.

Especially with the news that a shake up is imminent in the police department. So apparently, things can be done.
Maybe not enough, but more than nothing.

    • Uncle Reeno October 30th, 2014 at 13:40

Ya we should definitely give the benefit of the doubt to the stoned and violent thief that punched him in the face and tried to take his gun. What is this country coming to when a man can’t get lit, rob a convenience store, and assault a cop. Definitely racism, totally, ya…
