Harvard Law Professor Laurence Tribe explained to my radio audience that John Boehner has no standing to sue President Obama. Tribe taught both Obama and Supreme Court Chief Justice John Roberts and weighs in on them as well. He also discusses his feelings about how and why his own opportunity the sit in the High Court passed him by.

I understand the no harm, no standing argument. That’s pretty straightforward. What liberals don’t understand is the house HAS suffered harm. Small businesses wanted the mandate delayed. The house voted on it multiple times then Obama went and did it. He got the credit for what they were trying to do. Their reputations were harmed because Obama stole their thunder. (snark alert)

Obama needed to change Obamacare, but he had to do it at a time when the House was a majority of Republicans instead of Democrats, as it was when he was able to have the bill passed initially.
No way in hell was he going to let Congress have a crack at changing his signature legislation, because he knew it would come back with more changes than he bargained for. So he simply spoke law into being. Sometimes we call that a proclamation.

The executive branch is not empowered by the constitution to write legislation, the executive branch can use the power of the office to appeal to the legislative branch, and this limitation is not by accident. Limitations were deliberately put in place to prevent a monarchy.
Obama’s proclamation that “I have a phone and a pen”, could be construed as, “I have a crown and a sceptre”
It is the responsibility of congress to act as a check to executive power.
