Col. wants adultery charges tossed claiming discrimination against heteros

He believes the six charges against him should be dropped because the military rule banning extramarital sex discriminates against heterosexuals.

Col. Eugene Marcus Caughey is headed for an August court-martial on charges of rape, assault, taking a dirty selfie and the adultery counts. He was in court Monday for a formal reading of the charges and to argue pretrial motions.

Maj. Keith Meister, one of three attorneys defending Caughey, told Air Force judge Col. Wes Moore that the military’s definition of adultery as sex between a man and a woman hasn’t keep place with its definition of marriage, which now includes same-sex couples. That’s because the military’s adultery law requires “sexual intercourse” as an element of guilt, which the Pentagon defines as an act between a man and a woman.

“A homosexual man or woman couldn’t commit adultery as defined,” Meister argued.

    that’s a stupid argument. if they (gay/lesbian) aren’t married then they are not committing adultery. don’t want to be court-martialed for having sex outside of marriage, then don’t get fk’n married. damn. see that wasn’t so difficult.

          His lawyers are trying to exploit a a technical loophole in a Pentagon law that has not been updated for marriage equality. It takes a lawyer to do that.

          But, I have lawyers as fiends. Most are fine people.

      Actually, that wasn’t the argument. Maybe you should try reading what was actually written:

          in their arguments of “discrimination” and “equality” and “fairness”? I thought

          Secondly, how can you make something “equal” and “fair” or how can you have
          discrimination without mentioning that which you are trying to make it “equal”
          and “fair” or that which is discriminatory? How can homosexuals demand “equality” with “heterosexuals” without mentioning the group that they demand to be considered “equal” to? How can they show discrimination without mentioning heterosexuals?

          I don’t think the man and his lawyer were arguing that it did. According to the article,
          the man is facing charges for four different acts: “rape, assault, taking a dirty selfie and “adultery.” His argument of “discrimination against heterosexuals” is being made to combat and fight the charge of “adultery” and not the rape charge.

    Unfortunately, even if he is convicted, the worst that will happen to him is he’s forced to retire. He still gets a colonel’s pension, very easy to live on. And enlisted man doing the same thing gets a dishonorable discharge, and possibly a prison sentence. The military is definitely not classless. Twenty years enlisted, in case you can’t tell.

        In the past when an officer is forced to retire, as long as there’s no jail time, he still gets his pension. And an officer has to do something really monstrous, like murder, to get prison, where an enlisted man gets major punishment for less serious crimes. A general in Hawaii was arrested for DUI driving onto the base, and he just lost his job. I guarantee you an NCO would have gone to trial and done time. The reason is, it’s officers running the courts martial. It’s like the police’s blue wall of silence. You take care of your own.

          but, i’m hoping there are women on that panel and i don’t give a darn about the infidelity, it’s the rape that he should get time in prison for. think about it. rape occurs very often in the military and it’s dismissed, covered up or ignored, a col. getting busted for it, brings hope. but, i have to wonder, if it wasn’t for the infidelity, would he have been charged with rape?

      According to the article, the man is facing charges for four different acts: “rape, assault, taking a dirty selfie and “adultery.” It would then appear that the argument of “discrimination against heterosexuals” is being made to combat or fight the charge of “adultery” and not the other three charges. With that being the case, his argument makes sense.

    Marriage is legally a civil issue, divorce is a civil issue, why in hell is adultery a criminal issue? The guy seems to be a total jacka$$ for the rape and assault and his “argument” is ridiculous, but it’s time to drop adultery out of the UCMJ.
