Judge To Arpaio: Pay Penalties Out Of Your Pocket!

There’s at least one judge in this country who refuses to stick taxpayers with the bill for public corruption. More like this, please:

A federal judge says he will not consider calling off an upcoming criminal contempt hearing against Maricopa County Sheriff Joe Arpaio and his top deputies for failure to comply with court orders unless a settlement is reached and he’s confident Arpaio will pay money out of his own pocket.

“Let me make this clear, the schedule remains the same,” U.S. District Court Judge G. Murray Snow said Friday afternoon before ending a status conference. “If there is a settlement, let me know.”

The orders resulted from a 2007 class-action civil-rights case that alleges the Sheriff’s Office’s immigration sweeps amounted to discriminatory policing against Latinos. The hearing was scheduled before Arpaio, and Chief Deputy Jerry Sheridan consented to a civil contempt finding in a court filing earlier this week.

They admitted to the three areas alleged in contempt proceedings: evidence that the agency failed to abide by Snow’s December 2011 preliminary injunction to stop enforcing federal immigration law; evidence sheriff’s officials did not disclose all required information in pretrial proceedings; and evidence that Arpaio’s aides failed to properly follow Snow’s order to quietly collect deputies’ audio- and video-recording devices.

Maricopa County Supervisor Steve Gallardo said Arpaio’s admission is evidence he should be removed from office.

“Anytime you have the top law enforcement officer in Maricopa County thumbing his nose at federal court order, it’s time for him to go,” he said. …

Arpaio would also ask the county to set up an initial $350,000 to serve as a compensation fund for confirmed victims and would “seek to adjust this figure” should it not cover all of the claims.

Snow also questioned whether that money would come from Arpaio’s budget or from taxpayers. And he expressed concern about whether all victims could be identified and on setting a limit on the amount of money needed to compensate all victims.

“We are working diligently to identify these people,” Arpaio defense attorney Michele Iafrate told Snow. “There are outliers we may never find.”

Arpaio and Sheridan have also volunteered to personally donate $100,000 to a civil-rights organization with a mission of “protecting the constitutional and civil rights of the Hispanic community.”

Snow worried whether that money would come from Arpaio’s own pocket or his legal defense fund. He wants Sheridan to pay out of pocket too, but not as much as Arpaio because the judge said Sheridan has acted in good faith.

    Arpaio won’t pay out of his own pocket. He’s a “fiscal conservative” which means spending other people’s money for your societal agenda.

            Here in ‘nawlins the traditional day for red beans and rice is Monday because that was wash day in the past. Pot of red beans could simmer all day with occasional stirring. I like to cook them on Sundays where I can pay attention and spice when appropriate.

              i’m from ‘nawlins, born and raised. moved to texas in ’95. i know its tradition, but, i needs me some beans now. i cook them slowly as well. i forgot my bacon fat, so i just ran to the store a minute ago to get some bacon. cooking it now, then add to my pot.

    Since I sincerely believe that he illegally obtained a lot of the money that is in his own pocket and will be able to replace it with more from his supporters, I doubt that paying out of his own pocket will hurt him in the least. I applaud the judge for doing what he can but I do not understand how this man and his cohorts who have illegally kidnapped people with their “sweeps” (sounds so much better than kidnappings” have never been criminally charged and incarcerated. The corruption surrounding this system that Arpaio uses to bully the citizens is profound.
