He lost fair and square to Thad Cochran in Mississippi’s Senate primary on the Republican side. And now, after a failed attempt to overturn Cochran’s win, Chris McDaniel

… is arguing that a state court judge was wrong to dismiss his lawsuit that sought to overturn his Republican primary loss to incumbent Thad Cochran.

Attorneys for the tea party-backed candidate… filed legal arguments with the Mississippi Supreme Court late Thursday, hours before a midnight deadline.

The arguments mirror what McDaniel’s attorneys had said before Judge Hollis McGehee dismissed McDaniel’s lawsuit last month — that current state law does not specify a deadline for a candidate to challenge a primary loss.

McGehee had agreed with Cochran’s attorneys in saying a Mississippi Supreme Court ruling in a 1959 election dispute set a timeline for trying to overturn a primary loss, and that McDaniel waited too long to challenge results of the June 24 Republican primary runoff.

McDaniel attorney Mitch Tyner wrote in his brief Thursday that the 1959 Supreme Court ruling became irrelevant when the state Legislature rewrote election laws in 1986. …

No judge has ordered a do-over of a statewide election in Mississippi. If the Supreme Court overturns Judge Hollis McGehee’s ruling and sends McDaniel’s lawsuit to trial, McDaniel would have to prove that the election was so sloppily run that its outcome could not be known.

That’s a pretty tall order. I would not be surprised if McDaniel’s patrons are pressing the issue:

McDaniel received significant financial support from out-of-state groups trying to unseat longtime Republican senators they consider insufficiently conservative. McDaniel led a three-person Republican primary on June 3. Turnout jumped significantly when Cochran won the runoff three weeks later, including in predominantly African-American precincts where Cochran fared well.

Certified results show Cochran won by 7,667 votes.

McDaniel called the runoff a “sham.”

Riiiiight. Because everyone knows that votes in Ol’ Mississippi from those troublemaking minority types should not count in the first place!

Someone needs to sit McDaniel down and explain that bitter, racist, and litigious is no way to go through life, especially as a politician. ‘Nuff said.

        Even in Texas, if Dems turned out to vote in big numbers, the state would turn blue. But voter turnout in Texas sucks. Look at the Scottish independence vote last night. I think the turnout was somewhere between 85-90%.

          Americans–for all our rhetoric about freedom and democracy–are the very worst when it comes to getting up off of our asses and down to the polls. I’d like to see a mail-in ballot–it would improve turn-out and prevent a lot of the voter suppression efforts.

            The lines in Florida and other states during the presidential election had voter suppression on display. And they want to cut early voting.

              That’s why I’d like the mail-in ballot. They can’t shave points by making sure that the polls in Democratic-leaning districts don’t have enough booths. I was disgusted by seeing people–who probably had jobs to get back to–standing in line for 8 or more hours just to exercise their right to vote. A new trick they’re using is to make it illegal to step out of line to PEE…

                  It’s a ridiculous and dehumanizing requirement. I can’t see why voter suppression efforts aren’t being attacked as violations of our civil rights. Or perhaps that is what Holder is doing.

              In my borough you can vote early during business hours at the Clerk’s office, and I’ve been doing that for awhile now. I like it. It’s a small town, and I’m usually the only voter when I’ve done it. That way i don’t have to worry about inclement weather on election day–which we have a lot of that time of year.

              I’ve heard that. I’ll bet you get good turnout, too. With all the GOPTP shenanigans, I really wish that voting rules were made at the National level. Our rights shouldn’t be different depending on where you live.

                It’s a shame our rights depend on which part of the country you live in.. I’ve traveled to other states, and some of those states felt like a different country!

          Amazing isn’t it. The teabaggers have been harrassing the local democratic party and Battleground Texas for holding thousands of voter registration drives all over the state. We go to colleges, minority neighborhoods, suburban and urban neighborhoods. All went through the mandatory training and now the teabgg/gop are crying foul and demanding we go through more extensive(non-existent) training before we register anyone else. They lost that court battle but they do have large hordes of gop poring over all the paperwork.
