Big Soda Still Alive In New York City

Large-sized soft drinks have officially survived former New York City mayor Michael Bloomberg’s wrath. New York’s Court of Appeals ruled against reinstating the ban on large, non-diet sugary drinks Thursday.  The state’s highest court declared the health department overstepped its authority when restricting the sales of the 16-ounce beverages.

“The Board of Health engaged in law-making beyond its regulatory authority. It is clear that the Board of Health wrote the Portion Cap Rule without benefit of legislative guidance.”

The decision is consistent with a lower court that previously overturned the 2012 ban. Bloomberg originally proposed the bill in 2012 to combat obesity and other health issues. The limits would have applied to restaurants, delis, movie theaters, stadiums and street carts.
